These simplified Ts & Cs can be read in full at the time of hire. You will be required to sign the Waiver and/or Assumption of risk.
Assumption of Risk
I FULLY UNDERSTAND that injuries area common and expected part of mountain biking. The risks include, by way of example and not limitation, the following: collisions with other cyclists, pedestrians, vehicles, fixed or moving objects; falls; high speed descents, rapid or uncontrolled acceleration on hills and inclines, difficulty or inability to control one′ speed and direction, becoming lost or separated from other participants; equipment failures and malfunctions; slippery terrain, constructed features such as bridges; varying visibility; fatigue; dehydration; hypothermia; changing weather conditions, encounters with animals; stolen, lost, damaged or misplaced property. I understand the description of these risks is not complete and that unknown or unanticipated risks may result in property damage, illness injury, or death.
I ACKNOWLEDGE that (a) mountain biking is an inherently dangerous sport in which I participate at my own risk; (b) mountain biking involves risks and dangers of property damage, illness, serious bodily injury, including permanent disability, paralysis, and death, (c) these risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the trip.
• The period of hire commences at the time of collection and is deemed to continue until the bicycle is received by the owner as aforesaid.
• The owner shall not be liable for any damages caused or loss made whatsoever by breakdown or other defects in the bicycle or other circumstances beyond the owner’s control. The renter shall indemnify the owner in respect of all costs, claims, expenses, and demands which it may suffer or incur and which arise directly or indirectly out of the use of the bicycle during the period of hire.
• In the event of the bicycle being lost or stolen the owner reserves the right to call upon the renter to indemnify the owner the replacement value of the bicycle. However, should the bicycle subsequently be recovered in a useable condition, the owner undertakes to refund the renter’s indemnity within 14 days.
• The renter shall be solely responsible for, and shall keep the owner fully indemnified in respect of all fines, impositions or other penalties occasioned by the use of the bicycle during the period of hire in respect of violation on any Acts of Parliament, Orders, Regulations or Bye Laws for the time being in force.
